Gazprom, the Russian state gas company has been sued by several European energy companies with regard to non-performances of gas deliveries. Since the 2022 Ukraine conflict started, Gazprom has reacted to Europe’s blockage and seizure of its assets, including clients’ payments for gas deliveries. Legally, a problem was created for Gazprom: on the one side, Gazprom had the duty to deliver gas, but the Euro-payments would be blocked by sanctions and Gazprom would not receive the money. As consequence, Gazprom demanded that all gas shall be paid in Roubles, in advance – a method accepted by some purchasers. Those companies that refused to pay in Roubles did not get any gas and now are suing Gazprom. Uniper and OMV are the largest claimants of Gazprom and obtained arbitration decisions which can be executed in jurisdictions where Gazprom keeps properties. This may also be a matter for the Swiss companies running Nordstream which are either partly or fully owned by Gazprom.
